Letter sent to Oxford, MA police - 5/5/07

To whom it may concern

I am writing to you today about an incident that occurred 5-5-07 at approximately 2:30. I was following behind a friend of mine on his motorcycle driving on route 20. I had another friend in the car with me. We had just got off of 290 and where driving toward Southbridge on Rt.20. At the lights in front of pub 99 another motorcycle passed between my car(in the left lane)  and the car in the right lane. The person on the other motorcycle started to talk with my friend. At first the other biker looked like he was upset, but after a minute they seemed to be joking around. When the light turned green we started heading down route 20. Right after Cumberland farms and before oxford auto sales the other motorcycle came from the right lane and into the left lane where my friend was. He hit my friends’ bike in the muffler with the peg on the front of his bike. This almost wiped him out into the center of the road, but he was able to recover and not crash. The other motorcycle turned into oxford auto sales. I pulled over into centerfolds, following my friend into the parking lot, at which time we called the police. We had a picture of the person’s license place when we called. Right after we called the person on the other bike came into the parking lot. He then proceeded to come towards me, my friend, and his bike with a club. I grabbed the club as he was coming at us and tried to get him to let go of it. My friend with the bike called the police again to tell them we needed immediate assistance and the guy was attacking us. I tried to get the club away from the man for about 5 minutes. He told me that his marine buddies where on their way. When I saw the police coming I let go of the club since I figured I would be safe now and he went back to his bike. About that time a person who claimed to be the owner of centerfolds came up in his red landscaping truck. He seemed to have a relationship with the bike rider and maybe some of the police officers that arrived on the scene. The police talked to us quickly and then talked to the other motorcyclist. After this point they refused to listen to me or my passenger’s side of the story. We were both witnesses of this accident. Every time I tried to explain what I saw happen I was yelled at and threatened with arrest. I told the police I would like to press charges on the guy for attacking me, at which time he told me to I could get a police report from the oxford police station. Eventually I was told to leave. I asked if I went to the oxford police station if the police report would be there. At that point I was told "you do not run the investigation" and was told to leave before I was arrested.  I left very upset, to the point that i was shacking. I also did not realizing they still had my license. When I left the parking lot, there was a quick accidental chirp from my wheels. I continued down route 20 and suddenly one of the state cops from the scene was behind me and pulling me over. I was about 1/4 -1/2 a mile away from the scene when I was pulled over. I was given a $170 ticket. The cop then told me “I do have good news, I just saved a bunch of money by switching to geico”, at which point I left. The ticket was for the following.

$20 fail to use care starting – 720CMTC906

$50 seatbelt (one fee for me, one for my passenger) - 90-13AX2

$100 - Harsh and objectionable (tires) - 90-16

At this point I am not complaining about the ticket, that’s for the courts to decide. I just wanted to make the proper people aware about this situation. I do not feel the situation was handled in the right way. I was attacked and my friend was almost run off the road. I was also threatened by the man because he told me his marine buddies where on their way. Nothing was done. I was not given any information and I saw no action about this mans assault and battery. I was not really even given the chance to speak. The officer that told me to leave was Officer McDonald. The man who came after me had a license plate number of "XX258". I am including 5 pictures in this email. The first 3 pictures were taken by my passenger, and the last 3 pictures were taken by me.

*note - when i uploaded the pics to my site i had to convert them to png because i am having a problem with jpgs *

IMG_0565.JPG - Officers talking to the other person. The man who said he owned centerfolds in the green leaning against the police car. 3 police officers, the man and women from the bike

IMG_0567.JPG - Left side of the man’s bike who hit my friend. When I took the picture I was told he already fixed what happened to the bike (he said the peg was bent forward before it was fixed)

I also have a brief video footage showing both my friend and the motorcycle right before the crash (showing their position in the lanes). It was taken accidenly but shows them both clearly.  If you would like that let me know.

I will be coming to the station to get my police report.
